Patna High Court Grants Anticipatory Bail To Shopkeeper Accused Of Selling Duplicate Auto Parts

The Patna High Court has granted anticipatory bail to Rajesh Kumar Gupta, @Munna Gupta, who was accused in Amas P.S. Case No. 11 of 2025 for selling duplicate spare parts of Ashok Leyland Limited.

The FIR was lodged after a company representative, along with police, inspected shops on Hemzapur Highway Road and claimed that Rajesh Gupta and others were selling fake parts. The seized items were treated as duplicate company products.

Gupta’s counsel argued that the following:

There is no expert report or evidence proving the seized parts were fake.

His shop is GST registered (GST No. 10AEFPG7724Q1ZD), which is different from the case allegation.

He has no prior criminal record.

The court ruled that the absence of expert verification and Gupta’s clean background held that the case was based only on allegations. Justice Ajit Kumar, therefore, allowed anticipatory bail, but on the following conditions:

  • Bail bond of ₹10,000 with two sureties.
  • One surety must be a family member/relative with valid documents.
  • Gupta must attend all trial dates; missing two consecutive hearings without reason will cancel bail.
  • He must not threaten witnesses or tamper with evidence.
  • He must not commit any further offence.
